TERMS & CONDITIONS

All items are sold on an “AS IS” and “WHERE IS” basis with absolutely no warranty of any kind, including merchantability and/or fitness for a particular purpose. The auctioneer’s acceptance of the last bid constitutes a legally binding oral contract. When an item is sold, the buyer assumes all responsibility for their purchase. ALL SALES ARE FINAL.

BUYER'S PREMIUM: A 10% Buyer's Premium will be added to the highest bid to determine the final selling price of all items.

The order, method, bidding increments and time elapsing between bids will be at the sole discretion of the auctioneer. There will be no tie bids. The auctioneer’s decision is final.

The staff of Tritech Auctions has described the items in this auction to the best of their ability based on observations and information from sources deemed to be reliable, however, no guarantee is made.  It is the bidder’s responsibility to make inspections and confirm all descriptions prior to bidding.

PAYMENT TERMS: All items must be paid for on auction day during or immediately following the auction with cash, or check with proper ID made payable to Tritech Auctions. No items will be released until payment has been confirmed. We do not accept credit cards.

SALES TAX: Kentucky Sales Tax of 6% will be applied to all items. Dealers must provide a copy of their Sales and Use Tax Permit or their states equivalent, i.e. Indiana Registered Retail Merchant Certificate etc., along with proof (Business card, promotional literature, etc.) that they are regularly engaged in the business of selling the type of items for which the resale exemption is being claimed. ALL requests for sales tax exemption must be approved prior to the start of the auction. If you have any questions about sales tax, please contact Jesse Lyninger prior to bidding.

No items may be moved or removed until the entire auction is completed and payment has been made. All items must be removed on auction day (within two hours after conclusion of the auction) or on Monday, June 20th, between 9:00 A.M. – 4:00 P.M.. Any items not removed according to terms will incur removal and/or storage fees.

Title work for vehicles must be completed on auction day, prior to removal.

MOVING and LOADING: Tritech Auctions, Inc. does not provide any disconnection, loading, moving or rigging service. It is the responsibility of the Buyer to provide their own labor and equipment to remove their own items or make arrangements with an appropriate third party to move or load for them. All items must be removed in a workman like manner. Buyer is responsible for any damage to the property.

The auction company will, by its good practices, aid in the security of items; however, the ultimate responsibility for security of all items is with the buyer at the time of sale.

LP & Welding Tanks: Tanks on equipment are rented and therefore do not sell with the equipment.

The auctioneers and staff of Tritech Auctions, Inc. reserve the right to make purchases at all of our auctions.  

Additional terms and conditions may be announced by the auctioneer at the beginning of the auction. Announcements made by the auctioneer on auction day take precedence over advertising.
