TERMS

All items are sold on an “AS IS” and “WHERE IS” basis with absolutely no warranty of any kind, including merchantability and/or fitness for a particular purpose. The auctioneer’s acceptance of the last bid constitutes a legally binding oral contract. When an item is sold, the buyer assumes all responsibility for their purchase. ALL SALES ARE FINAL.

The order, method, bidding increments and time elapsing between bids will be at the sole discretion of the auctioneer. There will be no tie bids. The auctioneer’s decision is final.

The staff of Tritech Auctions has described the items in this auction to the best of their ability based on observations and information from sources deemed to be reliable, however, no guarantee is made.  It is the bidder’s responsibility to make inspections and confirm all descriptions prior to bidding.

PAYMENT TERMS: All items must be paid for on auction day during or immediately following the auction with cash, or check with proper ID made payable to Tritech Auctions. No items will be released until payment has been confirmed. We do not accept credit cards. 

BUYER'S PREMIUM:  10% Buyer's Premium is in effect for this auction.

No items may be moved or removed until the entire auction is completed and payment has been confirmed. All items must be removed on auction day (within two hours after conclusion of the auction) or on Monday, December 21, 2009, between 9:00 A.M. – 4:00 P.M.. Title work for vehicles must be completed prior to removal. Any items not removed according to terms will be considered abandoned and will be disposed of by the auction company at the expense of the purchaser.

Buyer is responsible for moving and loading their own items or making arrangements with an appropriate third party to move or load for them. All items must be removed in a workman like manner. Buyer is responsible for any damage to the property.

The auction company will, by its good practices, aid in the security of items; however, the ultimate responsibility for security of all items is with the buyer at the time of sale.

Kentucky Sales Tax of 6% will be applied to all items except titled vehicles. Please note: Indiana residents must pay sales tax on vehicles at time of purchase. Dealers must provide a copy of their Resale Exemption Certificate along with complete and signed documentation acceptable to the auction company on auction day. If you are not regularly engaged in the business of selling the type of items that you have purchased then you must pay sales tax. If you have any questions about sales tax, please contact Jesse Lyninger (502) 523-4151 prior to bidding. ALL requests for sales tax exemption must be approved in advance.

LP tanks are rented and therefore do not sell with the equipment.

The auctioneers and staff of Tritech Auctions, Inc. reserve the right to make purchases at all of our auctions.  

Additional terms and conditions may be announced by the auctioneer at the beginning of the auction. Announcements made by the auctioneer on auction day take precedence over advertising.
